K-1 Visa-
• K-1 is a fiancée visa people are complaining that there are no states that check the guidelines
• A K-1 visa is a visa issued to the fiancé or fiancée of a United States citizen to enter the United States.
• A K-1 visa requires a foreigner to marry his or her U.S. citizen petitioner within 90 days of entry, or depart the United States.
• Once the couple marries, the foreign citizen can adjust status to become a lawful permanent resident of the United States (Green Card holder).
• Although a K-1 visa is legally classified as a non-immigrant visa, it usually leads to important immigration benefits and is therefore often processed by the Immigrant Visa section of United States embassies and consulates worldwide.
• When you apply for that visa through the immigration service, they have to approve the petition, then it goes to the national visa center, then it has to go through the American counsel.
• The council will have to make sure you get fingerprinted and background checked as well as biometrics to see if your record is clean, and a personal interview.
• This process is to make sure that the terrorist stay out of the country.

• There is a system after that San Bernardino incident, as lawyers we turn inward and become somewhat academic and what it did was it caused me to do some research
• The Congressional Research Service has about a twenty five page memorandum that’s called visa security policies, I began reading it just to understand what the system is and where it may have fallen down
• The GAO had an additional report which is almost twice that size about refugees, and it’s interesting because when you look at the terroristic activities none of them have been carried out by refugees.
• That is not the people who they have problems with, the people who did 911 we’re on student visas the people who were involved in this case we’re talking about a person who is on a fiancée visa
• So I don’t think you know there’s been a lot of hoopla news about the security issues with refugees but I don’t think that’s where our system is falling down.
• Perhaps maybe our system is falling down in other visa classifications
• There was one 911 person who had applied for extension of his student visa granted after he died 6 months later.
• Basically after 911 they put these brakes on who can enter this country, they’ve stepped up the qualifications to be granted a visa into the country
• After 911 the Homeland Security Act which is what created the Department of Homeland Security, which is what really combined the databases so some of the databases that are out there is something called class which is the consular look out and support system.
• There is another database called the SAO, and then that’s the security advisory opinion
• Also there is the interagency checks and this is all data that is poured in from criminal databases from Interpol, from our intelligence agencies, and what we vet the names through these databases with the hopes that we’re going to find a potential problem but sometimes they don’t get picked up.

No Fly List
• Same information came through the no fly-list- The No Fly List is a list, created and maintained by the United States government’s Terrorist Screening Center (TSC), of people who are not permitted to board a commercial aircraft for travel in or out of the United States.
• We have an individual who is one of our clients whose CEO of one of the largest corporations in the country who was on the no-fly list and we provided all the documentation and still we cannot get him off the no-fly list it very frustrating because this is clearly an individual whose products are a household name
• There are many issues with this no fly list system
• Senator Kennedy- he used to live in Baltimore, and used to fly to Washington DC every. He goes to the airport, and boards the plane the flight attendant looks at him and says sir I’m sorry you cannot board the plane because you are on a no fly list, he called them and told them to immediately take them off.
• The Visa Waiver Program (VWP) is a program of the United States Government which allows citizens of specific countries to travel to the United States for tourism, business, or while in transit for up to 90 days without having to obtain a visa.
